1. Service Agreement
By engaging ChoppaLawnz services, you agree to these terms and conditions. Our services include lawn mowing, garden maintenance, house moving, furniture transport, and related property care services in the Wellington region, New Zealand.
2. Booking and Scheduling
Garden Services: Scheduled based on seasonal requirements: 2-weekly during summer months (October-March) and 3-weekly during winter months (April-September). Specific scheduling is subject to weather conditions and may be adjusted accordingly.
Moving Services: Bookings are scheduled based on availability and require confirmation at least 24 hours in advance for standard moves. Same-day and emergency services may be available with additional charges.
We will make reasonable efforts to maintain scheduled service dates. In case of weather delays or other circumstances beyond our control, services will be rescheduled to the next available date.
3. Free Trial Terms (Lawn Mowing Services Only)
Free trials are available to new customers who commit to ongoing lawn mowing packages for a minimum of 3 months. The free trial includes one standard lawn mowing visit. Free trials are limited to one per property, apply only to lawn mowing services (not garden maintenance), and cannot be combined with other offers.
Important: Garden maintenance services do not include free trials and are charged at standard competitive rates.
4. Payment Terms
Garden Services: Payment is due within 7 days of service completion unless alternative arrangements have been made. One-off services may require payment upon completion.
Moving Services: Payment is typically due upon completion of the move, unless prior arrangements have been made. Large moves may require a deposit.
We accept bank transfer, cash, or other agreed payment methods. Late payment may result in service suspension and additional administrative fees.
5. Cancellation Policy
Garden Services: Ongoing service agreements may be cancelled with 14 days written notice. Services cancelled within 24 hours of scheduled visit may incur a cancellation fee.
Moving Services: Cancellations must be made at least 24 hours in advance. Cancellations within 24 hours may incur charges up to 50% of the quoted price.
We reserve the right to terminate service agreements for non-payment or breach of terms.
6. Access and Safety
Customers must ensure safe access to properties and moving locations, and notify us of any hazards, including but not limited to: unstable structures, hidden obstacles, aggressive pets, chemical treatments recently applied to lawns or gardens, or difficult access conditions for moving services.
Garden Services: We are not responsible for damage to unmarked or inadequately marked irrigation systems, lighting, or decorative elements. Customers should clearly mark or identify such items before service visits.
Moving Services: Customers must ensure clear access paths and inform us of any building restrictions, elevator bookings, or parking limitations.
7. Weather and External Conditions
Garden Services: Services may be postponed due to adverse weather conditions including heavy rain, strong winds, frost, or unsafe ground conditions.
Moving Services: While we work in most weather conditions, extreme weather may require rescheduling for safety reasons.
Postponed services will be rescheduled at no additional cost.
8. Liability and Insurance
ChoppaLawnz carries public liability insurance covering both garden and moving services. Our liability is limited to the cost of the service provided. We are not liable for consequential damages, loss of use, or damages exceeding the service fee.
Moving Services: While we take utmost care with your belongings, customers are advised to arrange separate insurance for valuable or irreplaceable items. We maintain goods-in-transit insurance for standard household items.
Customers are responsible for ensuring pets are secured during all service visits. We are not liable for lost pets or pet-related incidents.
9. Property and Item Damage
Garden Services: While we take care to protect your property, normal wear from lawn mowing equipment is expected. We will repair or replace any items damaged due to our negligence, up to reasonable replacement cost.
Moving Services: We handle all items with professional care. Any damage must be reported immediately upon completion of the move. Pre-existing damage should be noted before the move begins.
Customers must report any damage within 48 hours of service completion. Claims reported after this period may not be honored.
10. Service Standards
We strive to maintain high service standards across all our offerings. If you are not satisfied with any service, please contact us within 48 hours, and we will make reasonable efforts to address your concerns.
11. Seasonal and Service Adjustments
Garden Services: Service frequency and scope may be adjusted seasonally based on grass growth rates and weather conditions.
Moving Services: Service scope may be adjusted based on actual requirements found on moving day, with customer approval for any additional charges.
Customers will be notified of any significant changes to scheduled services.
12. Equipment and Materials
All equipment and materials are provided by ChoppaLawnz unless specifically agreed otherwise. Customers should not attempt to operate our equipment or interfere with our service procedures.
Moving Services: Basic protective materials are included. Additional packing materials or special handling equipment may incur extra charges.
13. Privacy and Confidentiality
We respect your privacy and will not share personal information with third parties except as required by law. Property access information is kept confidential and used solely for service delivery.
14. Communication
Primary communication will be via email and phone. Customers are responsible for keeping contact information current. Service notifications, invoices, and other communications will be sent to the most recent contact information on file.
15. Dispute Resolution
Any disputes will be addressed through direct communication first. If resolution cannot be reached, disputes will be handled according to New Zealand consumer protection laws and may be referred to appropriate dispute resolution services.
16. Changes to Terms
These terms may be updated periodically. Customers will be notified of significant changes via email. Continued use of services after notification constitutes acceptance of updated terms.
17. Governing Law
These terms are governed by New Zealand law. Any legal proceedings will be conducted in New Zealand courts with jurisdiction over the Wellington region.
